1. User’s Acknowledgment and Acceptance of Terms

TradeMentor LLC (“Marcus”, “Us”, or “We”) provides the Marcus platform at tradementor.net and app.tradementor.net and various related services (collectively, the “Service”) to you, the user, subject to your compliance with all the terms, conditions, and notices contained herein (the “Terms of Service”), as well as any other written agreement between us and you.

BY USING THIS SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS OF SERVICE. IF YOU DO NOT WISH TO BE BOUND BY THESE TERMS OF SERVICE, PLEASE EXIT THE SITE NOW. YOUR REMEDY FOR DISSATISFACTION WITH THIS SERVICE IS TO STOP USING IT.

We expressly reserve the right to change these Terms of Service from time to time without notice. It is your responsibility to review these terms periodically. Your continued use of the Service after any modifications constitutes your acknowledgment and agreement to be bound by the updated terms.

2. Description of Services

Marcus is an AI powered trading coaching and accountability platform. The Service provides voice based real time mentorship, rule adherence tracking, session reviews, and behavioral pattern recognition to support traders in developing discipline and consistency.

We reserve the sole right to modify or discontinue the Service, including any of its features, at any time with or without notice. We will not be liable to you or any third party should we exercise such right.

3. What Marcus Is Not

Marcus is not a financial advisor. Nothing said by Marcus at any time constitutes financial advice, investment advice, trading advice, or a recommendation to buy, sell, or hold any financial instrument, security, futures contract, or any other asset.

Marcus is a coaching and accountability tool only. All trading decisions are made solely by you and are entirely your own responsibility. TradeMentor LLC is not registered as an investment advisor, broker dealer, or financial planner with any regulatory authority.

All information provided through the Service is for educational and coaching purposes only. While the information is believed to be accurate, none of it should be considered solely reliable for use in making actual trading or investment decisions.

4. Trading Risk Disclaimer

Trading futures, stocks, currencies, and other financial instruments involves substantial risk of loss and is not appropriate for all individuals. You may lose more than your initial investment. Past performance is not indicative of future results.

You acknowledge that:

  • Trading is inherently risky and you may lose all capital invested
  • Marcus is a coaching tool only and does not guarantee profitable trading outcomes
  • You are solely responsible for all trading decisions and their financial consequences
  • TradeMentor LLC bears no responsibility for any financial losses incurred while using the Service

5. Registration and Account Security

To access Marcus you must create an account by providing accurate and complete information. You agree to maintain and update your information to keep it current and accurate.

You are solely responsible for maintaining the confidentiality of your password and account. You may not transfer or share your account with anyone. Our personnel will never ask you for your password. You agree to immediately notify us at support@tradementor.net of any unauthorized use of your account or any other breach of security. We are not responsible for any loss or damage arising from your failure to comply with this provision.

6. Conduct on the Platform

Your use of the Service is subject to all applicable laws and regulations. You agree that you will not use the Service to upload, share, post, or otherwise distribute any content that:

  • Is unlawful, threatening, abusive, harassing, defamatory, fraudulent, or otherwise violates our policies
  • Infringes on any patent, trademark, trade secret, copyright, or other proprietary right of any party
  • Contains software viruses or any other code designed to disrupt, damage, or limit the functioning of any software or hardware
  • Impersonates any person or entity

We reserve the right at our sole discretion to terminate your account for violation of any of the above provisions. We may cooperate fully with law enforcement authorities in investigating suspected criminal violations.

7. Subscriptions and Billing

Marcus is offered on a monthly subscription basis at $49 per month.

Free trial: New users receive a 7 day free trial. A valid credit card is required at signup. Your card will be charged $49 on day 7 unless you cancel before then.

Billing: Subscriptions are billed monthly on the same date each month via our third party payment processor.

Cancellation: You may cancel your subscription at any time through the Manage Subscription option in your account settings. Cancellation takes effect at the end of the current billing period.

Refunds: No refunds are issued after the trial period ends and the subscription is charged. You may cancel at any time before your next billing date to avoid future charges. TradeMentor LLC is not responsible for continued subscription charges should a user forget to cancel their account. It is the user’s responsibility to confirm cancellation.

Failed payments: If a payment fails you will have a 3 day grace period to update your payment details before access is suspended.

All content, features, functionality, branding, and technology within the Marcus platform are the exclusive property of TradeMentor LLC. You are only permitted to use the Service as expressly authorized by us.

You may not copy, reproduce, modify, republish, upload, post, transmit, distribute, or use for any commercial purposes any portion of this Service without prior written permission from TradeMentor LLC. Any unauthorized use may violate copyright, trademark, and other applicable laws and could result in criminal or civil penalties.

All custom graphics, icons, logos, and service names associated with Marcus are trademarks or service marks of TradeMentor LLC. Nothing in these Terms grants you any right to use any trademark, service mark, logo, or the name of TradeMentor LLC.

9. Disclaimer of Warranties

ALL MATERIALS AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

WITHOUT LIMITING THE FOREGOING, WE MAKE NO WARRANTY THAT:

  • (A) THE SERVICE WILL MEET YOUR REQUIREMENTS
  • (B) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE
  • (C) THE RESULTS OBTAINED FROM USE OF THE SERVICE WILL BE EFFECTIVE, ACCURATE, OR RELIABLE
  • (D) ANY ERRORS IN THE SERVICE WILL BE CORRECTED

THE USE OF THE SERVICE IS DONE AT YOUR OWN DISCRETION AND RISK.

10. Limitation of Liability

IN NO EVENT SHALL TRADEMENTOR LLC OR ITS AFFILIATES BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY SPECIAL, PUNITIVE, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION THOSE RESULTING FROM LOSS OF USE, DATA, OR PROFITS, WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM YOUR USE OF MARCUS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 30 DAYS PRECEDING THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

11. Indemnification

You agree to defend, indemnify, and hold TradeMentor LLC and its affiliates harmless from all liabilities, claims, and expenses, including attorney’s fees, that arise from your use or misuse of the Service or your violation of these Terms of Service.

12. Termination of Use

We may in our sole discretion terminate or suspend your access to all or part of the Service with or without notice and for any reason, including breach of these Terms of Service. Any suspected fraudulent, abusive, or illegal activity may be grounds for terminating your account and may be referred to appropriate law enforcement authorities.

Upon termination your right to use the Service immediately ceases and we may deactivate or delete your account and all related information. We shall not be liable to you or any third party for any claims or damages arising out of any termination or suspension.

13. Governing Law

These Terms of Service are governed by the laws of the State of California. Any disputes shall be subject to the exclusive personal jurisdiction and venue of the courts of competent jurisdiction within the State of California.

14. Notices

All notices shall be made via email. Notices to us must be sent to support@tradementor.net. We may also broadcast notices through the Service to inform you of changes or matters of importance.

15. Entire Agreement

These Terms of Service constitute the entire agreement between us concerning the subject matter herein and supersede all prior agreements. These Terms may not be altered or amended except by a written agreement signed by both parties. If any part of these Terms is held invalid or unenforceable, the remaining portions shall remain in full force and effect.

Any failure by us to enforce any provision of these Terms shall not constitute a waiver of that right or provision.
